NuggetsAI is a mobile-first platform that provides curated, AI-assisted insights ("Service"). These Terms form a binding agreement between you and NuggetsAI ("we/us"). By accessing or using the Service, you accept these Terms.

• You must be 13+ and capable of forming a contract. Where local law requires higher age or parental consent, you must comply.
• Keep your account secure; you're responsible for activity under it.
• We may refuse, disable or reclaim usernames, and suspend/terminate accounts for risk, misuse, or non-payment.

• We offer a free tier with caps and a Pro subscription with expanded access. Actual limits and features are as shown in-app and may change at any time.
• We may implement fair-use controls (e.g., daily view caps, save/collection caps, anti-abuse checks) and may adjust or enforce them without notice to maintain Service integrity.

• Pro renews automatically monthly until you cancel. Current price is shown in-app (presently USD $9/month, subject to change). Applicable taxes may apply.
• Payments are processed by Stripe; we don't store full card details.
• Cancellations: take effect at the end of the current period. Fees are non-refundable except where required by law or if we state otherwise in writing.
• We may change prices or plans with reasonable notice (by email, in-app, or on the site). Continued use after changes constitutes acceptance.

You agree not to:

• Copy, scrape, or bulk export beyond permitted use; attempt to circumvent rate limits or access controls.
• Misuse, reverse engineer, probe, or disrupt the Service or others' use.
• Upload or share unlawful, infringing, deceptive, or harmful content; violate others' rights (IP, privacy, publicity); or use the Service for automated spam or fraud.

We may monitor and act to prevent abuse.

• All technology, features, designs, compilations, and branding are our IP or our licensors'. You receive a limited, revocable, non-transferable right to access the Service for your personal or internal business use.
• Attribution & excerpts: The Service may display short excerpts or references to third-party sources with attribution under fair dealing/fair use or applicable licenses. We do not claim ownership of third-party works.
• User inputs/feedback: You retain rights in your inputs and collections; you grant us a worldwide, non-exclusive, royalty-free license to use them to operate, improve, and secure the Service (including for moderation, analytics, and model quality, where permitted).

If you believe material on the Service infringes your rights, email team@nuggetsai.com with:

• Your contact info; identification of the work; the specific URL(s); a good-faith statement of rights; and a statement under penalty of perjury that your notice is accurate and you are authorized to act.

We respond to valid notices and may remove or disable content at our discretion. (For US notices, please label your email "DMCA Notice".)

To the maximum extent permitted by law:

• The Service and content are provided "as is" and "as available" without warranties of any kind (express or implied), including fitness, accuracy, or non-infringement.
• We do not warrant outcomes; AI-assisted outputs may be incomplete, outdated, or wrong.

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies non-excludable consumer guarantees. Where permitted, our liability for breach of a non-excludable guarantee is limited to re-supply of the Service or payment of the cost of re-supply.

To the maximum extent permitted by law, in no event will we be liable for indirect, incidental, special, exemplary, or consequential damages, lost profits, data loss, business interruption, or reputational harm.

Our total aggregate liability for all claims in any 12-month period is limited to the fees you paid to us for the Service in that period (or USD $50 if you are on the free tier).

You will defend, indemnify, and hold harmless NuggetsAI and its affiliates, officers, and staff from claims, losses, and costs (including reasonable legal fees) arising from your misuse of the Service, your content, or your breach of these Terms or applicable law.

If you reside outside the United States:

• Governing law: New South Wales, Australia, excluding conflict rules.
• Disputes: Binding arbitration under ACICA Rules in Sydney (one arbitrator; English). Either party may seek injunctive relief or bring an individual small-claims case where permitted.

If you reside in the United States:

• Individual binding arbitration under AAA Consumer Arbitration Rules in your county (or remote by default), English. No class actions or representative proceedings to the extent allowed by law.
• 30-day opt-out: You may opt out of arbitration/class waiver by emailing team@nuggetsai.com within 30 days of creating your account, stating your name and the email tied to your account.

We may update these Terms from time to time. We'll post the updated version and adjust the "Last updated" date. Material changes will be notified by email or in-app. Continued use after changes means you accept them.
